You are hereby accused of improper conduct and disloyalty to the Dairy Workers Association.
Article X – Removal of Officers/Members
B. In the event any member or officer is accused of improper conduct or disloyalty to this organization, he/she shall be tried in the following manner.
For the accusation of improper conduct, as acting President I believe there is sufficient evidence to prove misappropriation of funds during your three-year term as xxxx xxxxxxxxx. With this evidence I will provide years of bank statements, cancelled checks, receipts, and three years of LM-3 reports to back this claim.
When the current administration for the Dairy Workers Association took office the officers and representatives were asked to return all Union property paid for by the Union. According to Check # 5507 you purchased a computer in the amount of $1838.14. The computer in question was never returned nor the bag purchased with it.
On 10/13/23 you were given a letter from the Dairy Workers Association where you were attempting to be considered for the vacant Secretary position at the time. Both the Executive Board as well as the Board of Trustees denied your appointment to be voted upon by the members at the next scheduled meeting as per the bylaws. You were deemed to not be in good standing for the alleged offenses of misappropriation of funds, disloyalty, and for your failure to return the computer purchased by the Dairy Workers Association.
For the accusation of disloyalty, I believe I have sufficient evidence to prove this claim. Your current xxxxxxxxx xxxxxxxxx xxxxxxxxx xxxxxxxxxxx xxxxxxxxxxxxx xxxxxxxxxx is not a negotiated position within the CBA between the Dairy Workers Association and Cream-O-Land Dairy. As a result, you have taken on a xxxxxxx xxxxxxxxxxxxx xxxxxxxxxxxxx xxxxxxxxxxxxxxx xxxxxxxxxxxxx. I will provide written testimony of alleged interaction between you and current members as well as with management that violates the Dairy Workers Association’s bylaws.
Article X – Removal of Officers/Members
All members are expected to keep Union matters private: Disclosure of activities and private matters to the company personnel will have an affect on any negotiations or agreements to improve benefits and conditions for all members, and therefore can result in loss of membership for the offender.
In addition to these charges as President I will prove that you are not in good standing as a member by providing the contact information of Federal Department of Labor investigators for you to further inquire on your own. I will provide multiple emails and testimony between Dairy Workers Association and the Federal Department of Labor showing their involvement in an investigation of the Dairy Workers Association during the time you served as xxxx xxxxxxxx.
Article III – Members
A member in good standing will consist of that member be current on his/her dues and he/she must not be under investigation by the Union or any court of law in any jurisdiction of the United States of America.
These are your charges of offense against the Dairy Workers Association xxxxxx. According to the bylaws they will be presented to you after they are given to the Secretary. From there they go to me as acting President. From there I will call for a meeting. Before the meeting I will meet with the Executive Board and the Board of Trustees to see if a trial is warranted.
At the meeting the membership shall select three members to serve as the trial board. The trial board will hear the evidence provided by me as well as your defense at said trial. If a trial is warranted you will be able to have one member in good standing to defend you against these charges.
Pertaining to anonymity I already spoke with the Union attorney and given the nature of these offenses and the number of members involved this will be hard if not impossible to maintain. However, on my end, outside of the rules in the bylaws for those that need to be involved, I will keep the matter quiet.
You must be aware that if a trial is warranted and supported by the Executive Board and the Board of Trustees you may face expulsion from the Union if found guilty.
